General terms and conditions of trade
Our ultimate ambition is to have satisfied customers. Therefore we have defined some rules which you find in the section below. We kindly ask you to read them attentively.
Applicability:
These rules are including all contracts and/or contractual agreements regarding acquisitions and delivery of goods contracted between customer(s) and Hutstuebele OHG in this documentation named „Hutstuebele.com“.
Prices and Delivery charges
All our prices are quoted in EURO € and include the VAT (value added tax) required by Italian law. Not included are delivery charges you`ll find on SHIPPING INFOS.
Value added tax
VAT is payed in Italy by Hustuebele.com. VAT is reclaimable when the legal required evidences are presented. For this service Hustuebele.com is charging an administration fee of 25,- €.
VAT Switzerland
All deliveries are billed strictly net. The customer is obligated to accomplish the payment of tax and duty in his specific home country.
VAT (Europe)
Zero-rated VAT deliveries within Europe is only possible after presenting a valid UID number and when the value amount of goods is higher than 250,- €. If the value amount is less than 250,-€ Hutstuebele.com has to charge an administration fee of 25,- €.
Custom duties NON-EU-Member state(s)
Please note: All non-EU-Member states are subjected to the specific national custom regulations. We do not have any information about these regulations and there are not displayed any regulations and/or fees in our web-shop. Please take the relevant information from the authorities in your home country. Custom duties are non-deductible from the invoice amount.
Hutstuebele.com is providing all information regarding prices and delivery charges with high diligence. In case of failures, bugs or other disfunction of third party systems (systems not operated by Hustuebele.com) only the price displayed in the appropriate web-shop is valid.
Return consignment
If the customer takes advantage of return consignment the goods have to be sent to the return address below.
Please take the following steps:
a) inform hustuebele.com about the intention of return consignment (via e-mail)
b) Complete the Return document (by describing the reason of return)
c) return the goods including all labels and send them originally packed.
d) Take use of the attached return address tag
The costs of return consignments are payed by the customer. Eventual costs of a compensation delivery are covered by Hutstuebele.com. Please note: delivery costs are only charged once per order.
Advices for return consignments:
- Most of our articles can be sent and charged as “letter” not as “parcel”. Please ask the detailed information in your post office. You can save money.
- Hutstuebele.com is recommending to send any parcel by registered post. There is normaly included the insurance and you receive a certificate of delivery.
- Attention: return consignments in absence of cost of postage cannot be accepted. Refunding claims regarding the costs of return consignments after positive validation are credited to the specific customer account or transferred to the customer`s banking account (maximum amount = 15 € per order). Please note that the prerequisite for any return consignment is the written approval (via email) by Hutstuebele.com and the receipt of payment.
In the following cases Hutstuebele.com does not assume any liability:
- The size of the ordered goods is not matching with the required size but the size of the delivered goods complies with the current order
- variation of colour
- etc.
Refundings can only be completed after the detailed banking information have been submitted:
- Bank Institute
- road
- Zipcode
- City
- Country
- IBAN and BIC Code
The duration of refunding is 30 workdays after validation.

Advices for return consignments
The return consignment is fulfilled when the goods have reached the return address. The customer is assuming the liability for the successful completion of the return consignment.
Order process / contract conclusion
There are different possibilities to order. You are able to place the order in one of our shops: via phone, fax, letter, or email. In any case it is required that the person who is placing the order is full-aged.
Completing your order you are required to confirm our terms of trade. Please read them attentively.
At any time you are placing an order on Hutstuebele.com your IP-adress is saved by our system for security reason and to prevent any kind of fraud. The Ip-adress is individual and allows to identify each internet-user. Any kind of fraud or abuse has to be reprted to the authorities.
In exceptional cases Hutstuebele.com reserves the right to not accept the order.
The purchase agreement becomes legally at the earliest with the delivery of the goods.
The right of withdrawal
Any contract can be cancelled within 7 workdays without giving any reason. The cancellation of the order has to be completed via letter, fax, email or trough return consignment of the goods.

Consequences of withdrawal
In case of effective withdrawal each party has to return all benefits which had been further received. Damages or use of goods is charged. Hutstuebele.com is charging the goods it they cannot be returned in excellent conditions. If the withdrawal is causing delivery costs Hutstuebele.com is charging a flat fee of € 15,00.
Delivery
Hutstuebele.com is exercising the highest possible care in accepting and proceeding of orders. Hutstuebele.com is proceeding the orders as quickly as possible in the sequence “first in first out”. Delivery is completed within 5 – 7 days for Germany, for Austria in 2 – 4 days. If the delivery is not possible due to other reasons customers are informed within 48 hours after the order has been placed (max. 14 days).
If the customer is not accepting the delivery of the goods without any qualified reason, or if the goods are undeliverable (for inst. due to wrong indication of the delivery address by the customer) Hutstuebele.com is charging a flat fee of 15,- € for cost refunding.
Please pay attentation: Hutstuebele.com is not able to deliver to packing-stations. Orders of goods can only be accepted when the order size is matching with common household quantities.
Terms of payment:
Hutstuebele.com is offering different facilities for payment they depending on the specific delivery address may vary:
- PAYPAL (worldwide)
- VISA and MASTERCARD (worldwide)
- Prepaid (worldwide)
- Bank transfer (Europe, after the 2nd order )
Advices for payment by Creditcard VISA / MASTERCARD: for any negative booking operation regarding amounts already payed by Creditcard please contact first Hutstuebele.com. For unjustified annulation the credit card company is charging a chargeback-fee of (minimum)35 €. In case of unjustified annulation by the customer, Hutstuebele.com is charging this fee back to the causer. In case of justified annulation Hutstuebele.com is transferring the amount without any costs back to the customer banking account.
Adivces for bank transfer: possible only for specific countries and after the 2nd order. To avoid additional transfer costs the use of IBAN and BIC/SWIFT Code is mandatory. The vendee is obligated to pay all occurring transfer costs. Deduction of discounts are not allowed, excepted when otherwise stipulated. The payment process is completed once the invoice amount has been received. The payment date is the payment entry date on the bank account and not the completion date.
Terms of payment:
- Prepaid when Payment is effected by paypal or credit card
- Period of payment of 14 days when payment is effected on account
Delay of Payment
If payment is not completed within 30 days on receipt of invoice the vendee is defaulting, independently of having received any reminder. Hutstuebele.com is reserving all rights to charge any kind of effort regarding occurring cost due to request(s) of payment (EURO 15,- for each request) and/or to forward the claims to a collection agency charging additional costs to the vendee. When claims are completed by collection agency and/or lawyer Hutstuebele.com is charging also the legal fees provided by law. Accepting the general terms and conditions of trade provided by Hutstuebele.com the vendee is agreeing expressively that in case of delay of payment Hustuebele.com is allowed to transfer the relevant data to the specific collection agency for further use and publishing in the official debitor data base.
Colors
There are possible discrepancies between colors displayed in the webshop and the colors of the delivered articles. This is depending on local not influencable technical features and Hutstuebele.com is not assuming any liability that colors displayed in the shop are matching at any time with the colors of the delivered goods.
Privacy
All personal data transmitted to our web shop environment is protected by a 1024bit coded Server which guarantees the highest level of security whenever data are transferred due the Internet. If customers do not agree transferring the data in this way they are allowed to submit it via fax: +39-0472-207-992.
Please note: Italy has one of the strictest privacy laws in all over Europe. Hutstuebele.com is completely compliant and guarantees not to transfer any personal data to third parties excepting data required by law.

Title retention
Until the full payment is completed the goods remain property of Hutstuebele.com. Whenever the customer is acting contrary to the agreement especially in case of delay of payment, reselling of goods without complete payment, Hutstuebele.com is reserving all rights to claim for compensation.
Legally protection of images
All rights regarding images displayed on the webshop of Hustuebele.com are reserved by Hutstuebele OHG and/or their licenser. For any further use of images it is required a specific authorization by Hutstuebele.com.
Warranty
In any case of defects, Hutstuebele.com is following the legal right. Any kind of defects regarding material or production failure(s) please escalate immediately to Hutstuebele.com. Any kind of defects caused due transport please communicate immediately to the supplier who delivers the articles. Hutstuebele.com is not assuming any liability for improper use by the customer.
Liability
Hutstuebele.com is not assuming any liability for printing or display failures on any kind of promotion material. Non-liability also in case of slight negligence.
General terms and trades differing by customer
Whenever the customer would like to refer to its own general terms and trades it is not accepted by Hutstuebele.com. All transactions are subjected to Hutstuebele.com “general terms and conditions of trade”.
Miscellaneous
If one or more terms defined in the present documentation due to legal changes becomes inapplicable all other terms will not be affected. The inapplicable terms are substituted with the new legal terms which are compliant with the economic interest of both parties.
Applicable Law and place of Jurisdiction
On the general terms and conditions of trade there is applicable only Italian Law excluded the section regarding terms of International Privat Law. The place of Jurisdiction is BOLZANO / BOZEN (BZ).
